Ektogestation und 'Artifizielle Amnion- und Placenta-Technologie' - Rechte von schwangeren Personen im Zuge der Weiterentwicklung extrakorporaler Reproduktionstechnologie

Abstract

Im Zusammenhang mit der medizintechnologischen Vision über Schwangerschaftsprozesse außerhalb des Körpers werden 'Lösungen des Abtreibungsproblems' diskutiert. Der Beitrag analysiert die dominanten Debattenstränge und deren antifeministische Motive sowie deren Relevanz im deutschsprachigen Kontext. Ziel des Beitrags ist es, die Diskussion zum Thema auch im deutschen Kontext voranzutreiben und eine intersektionalfeministische Perspektive miteinzubeziehen. Mittels einer hermeneutischen Textanalyse bioethischer und juristischer Literatur sowie politischer Stellungnahmen (Deutscher Juristinnenbund; Doctors for Choice) wird erörtert, welche Auswirkungen die Zentralisierung des 'moralischen Status' des Fötus sowie die Ausweitung fötaler Lebensfähigkeit durch die Weiterentwicklung extrakorporaler Reproduktionstechnologie haben können. In Reflexion auf den deutschen Kontext zeigt die Untersuchung weitere mögliche Effekte bezüglich selektiver Reproduktion und der Neuregelungen zum Schwangerschaftsabbruch auf. Der Beitrag plädiert für eine breitere Kontextualisierung von Abtreibungen, um die biopolitischen Zusammenhänge zu verstehen und verkürzte Schlüsse anhand des Einsatzes medizintechnologischer Innovationen zu verhindern.

The article discusses "solutions" to the "abortion problem" in the context of the medical technology vision of pregnancy processes outside the body. It analyses the dominant strands of the debate, their anti-feminist motives and their relevance in the German-speaking context. The aim is to also advance the debate about the topic in the German context and to incorporate an intersectional feminist perspective. The effects of the centralization of the "moral status" of the foetus and the expansion of foetal viability through advancing extracorporeal reproductive technology are discussed by conducting a hermeneutic textual analysis of bioethical and legal literature as well as political statements (German Women Lawyers' Association, Doctors for Choice). Looking at the German context, the article highlights further possible implications for selective reproduction and the upcoming revision of abortion legislation. The article argues in favour of the broader contextualization of abortion in order to understand the biopolitical contexts and to avoid reductive conclusions based on the use of innovations in medical technology.
