"Vater Staat": ein vorhersehbares Comeback: Staatsverständnis und Staatstätigkeit in der Moderne

Abstract

Die theoretische Reflexion der Staatstätigkeit, die ich im vorliegenden Beitrag präsentieren möchte, stellt einen für moderne Staatlichkeit konstitutiven funktionalen Antagonismus heraus. Ein funktionaler Antagonismus ist ein strukturiertes Gegeneinander von Handlungsorientierungen und -wirkungen, das sich aber trotz aller Konflikthaftigkeit nicht destruktiv, sondern produktiv auswirkt. In der im ersten Teil anzusprechenden historischen Semantik der Moderne stellt sich der funktionale Antagonismus als Gegeneinander eines reduktionistischen und eines emergentistischen Staatsverständnisses dar. Diese Beschaffenheit des Denkens und Redens über den Staat ist eine wichtige Prägung der Staatstätigkeit. Ihre strukturelle Prägung erhält sie allerdings daraus, dass - wie ich im zweiten Teil erörtern werde - der moderne Staat Teil einer zugleich funktional differenzierten und kapitalistischen Gesellschaft ist. Deshalb unterliegt die Staatstätigkeit einem funktionalen Antagonismus von demokratischem Staat und Steuerstaat.

The theoretical reflection of the modern state presented in this paper emphasizes a functional antagonism which is a constitutive element of modern statehood. A functional antagonism is a structured opposition of orientations and effects of activities which, however has no destructive but a productive overall impact. In the first part the functional antagonism is described on the level of interpretations of modernitiy as an opposition of an emergentist and a reductionist understanding of the modern state. This way of thinking and talking about statehood is an important cultural factor which shapes the working of the modern state. Its structural shape - as I will show in the second part - results from its position in a society which is characterized by a functional antagonism of functional differentiation, on the one hand, and capitalism, on the other. This constitution of modern society brings about a functional antagonism of democracy and tax-dependency for the working of the modern state.
