Das demokratische Recht sich gegen Abschiebungen zu wehren

Abstract

Im Beitrag wird mit Bezug auf den Philosophen Étienne Balibar ein Argument für ein demokratisches Recht entwickelt, sich gegen Abschiebungen zu wehren. Folgt man den Implikationen von Gleichfreiheit und der Unterscheidung zwischen konstituierter und konstituierender Macht, stößt man auf die Wurzel radikaler Demokratie - auf einen Demos, der unbestimmt bleibt und sich zwischen Verfassung und Aufstand konstituiert. Im Folgenden soll gezeigt werden, dass die sedimentierten Formen von Volkssouveränität, wie Rechtsnormen und Wahl, nicht die einzigen Instrumente zur Konstitution von Volkssouveränität darstellen. Anhand der Suffragetten-Bewegung soll gezeigt werden, dass Aufstand und Protest in der Geschichte der Volkssouveränität eine entscheidende Rolle gespielt haben und auch heute Ausdrücke der konstituierenden Prozesse demokratischer Selbstregierung darstellen.

The article develops an argument for a democratic right to resist deportation with reference to the philosopher Étienne Balibar. Following the radical implications of equaliberty and the distinction between constituted and constituent power, one encounters the root of radical democracy - a demos that remains indeterminate and is constituted between constitution and insurrection. In the following, I will show that sedimented forms of popular sovereignty, such as legal norms and elections, are not the only instruments for constituting popular sovereignty. The suffragette movement will be used to show that insurrection and protest have played a crucial role in the history of popular sovereignty and continue to be expressions of the constituent processes of democratic self-government today.
