Greift die (arbeits-)rechtliche Autonomiegewährleistung noch, wenn marktförmige Kontrollinstrumente wie z. B. Zielvereinbarungen, Ertragsziele, Cost- und Profitcenter oder innerbetriebliche Marktbeziehungen traditionelle Steuerungsinstrumente wie die hierarchische Weisung ersetzen? Welche Konsequenzen hat es für den rechtlichen Schutz der Autonomie von Arbeitskräften, wenn nicht mehr das hierarchisch strukturierte und bürokratisch organisierte Unternehmen, sondern Netzwerkstrukturen den Rahmen bilden, in dem Arbeit organisiert wird? Dieser Beitrag verknüpft sozial- und wirtschaftswissenschaftliche Erkenntnisse zur Vermarktlichung und Vernetzung von Unternehmen mit einer (arbeits-)rechtswissenschaftlichen Analyse der Gewährleistung von Autonomie. Es wird die These entwickelt und an Beispielen erläutert, dass die Absicherung der Autonomie von Arbeitskräften gegenüber indirekter Steuerung und Überwachung in marktorientierten Arbeitskontexten eine zentrale Herausforderung des (Arbeits-)Rechts ist, die zum einen eine Schärfung der arbeitsrechtlichen Instrumente zur Absicherung der Autonomie von Arbeitnehmern erfordert und zum anderen neue Instrumente zur Absicherung der Autonomie von Solo-Selbständigen im Hinblick auf die Verhandlung von Rahmen- und Kontextbedingungen verlangt.... view less

Does (labour) law-related protection of autonomy still work, if marked-led instruments of control such as agreements on objectives, profit targets, cost and profit centers or internal market relationships replace traditional instruments such as instructions by superiors? What are the consequences for the legal protection of autonomy, if the use of labour is not framed by a traditional hierarchical and bureaucratic company but a network organization of cooperating companies? In this article findings of social and economic sciences about the marketization and the networking of companies are linked with a legal analysis of the protection of autonomy. The article develops the argument that the protection of autonomy against indirect control in a marked-led working world is a key challenge for the years ahead in (labour) law. What is necessary is a sharpening of the instruments protecting the autonomy of employees and of self-employed workers with regard to the negotiation of framework and contextual conditions of work.... view less
