El movimiento indígena nacional: ¿Único actor capaz de "destrabar" el conflicto?

Abstract

Este artículo trata sobre la situación de los derechos indígenas en el conflicto entre el EZLN y el gobierno federal mexicano. Se busca demostrar cómo el contenido jurídico de las reformas constitucionales -empleadas en diversos momentos para impulsar u obstaculizar el diálogo y la negociación con los zapatistas a lo largo del conflicto- ha quedado subordinado a una disputa de orden político y militar. Asimismo, y en el contexto posterior a los ataques terroristas del 11 de septiembre de 2001 en Estados Unidos, se analizan las opciones del movimiento indígena nacional mexicano para conseguir sus derechos y contribuir, al mismo tiempo, al acercamiento entre el EZLN y el gobierno federal.

This article discusses the issue of the rights of the indigenous peoples within the ongoing conflict between the Zapatista Army of National Liberation and the Mexican federal government. We intend to prove that the legal substance of the constitutional reforms, put forth during the conflict, has been subsumed by the military and political struggle, although these reforms have been used, for a while, either to further or to hinder the negotiations with the Zapatistas. Moreover, and in the aftermath of the 9/11 terrorist attacks in the United States, there have been some endeavors to discuss options for the Mexican indigenous peoples’ movement to stand for their rights while collaborating to achieve a rapprochement between the Zapatista Army and the Mexican government.
