'Die neue ukrainische Verfassung, die am 28. Juni 1996 vom Parlament verabschiedet wurde, ist ein 'Kind des Kompromisses' zwischen der Exekutive und der Legislative einerseits, und des Kompromisses zwischen den politischen Parteien und ideologischen Positionen andererseits. Die Analyse der neuen ukrainischen Verfassung und ein Vergleich mit der rußländischen führt zu der Schußfolgerung, daß die Ukraine eine Mischform zwischen präsidialer und parlamentarischer Demokratie gewählt hat. Diese parlamentarisch-präsidiale Form der Demokratie mit drei Gegengewichten (Präsident, Parlament und Regierung) soll die Rückkehr zum Machtmonopol einer Gewalt ausschließen. 'The new Ukrainian Constitution, passed by Parliament on 28th June 1996, is a 'child of compromise' between the Executive and the Legislative on the one hand and of compromise between the political parties and ideological positions on the other. An analysis of the new Ukrainian Constitution and a comparison with its Russian counterpart leads to the conclusion that Ukraine has chosen a hybrid form between a presidential and a parliamentary democracy. This parliamentary/ presidential form of democracy with three counter-weights (President, Parliament and Government) is intended to rule out a return to a monopoly in the hands of one of the three branches of power. In the course of three months after the adoption of the new Constitution, a fourth counter-weight was established: the Constitutional Court.' (author's abstract)... view less
