"Schuld und Strafe sind keine Naturgegebenheiten, sondern in einem Jahrtausende alten gesellschaftlichen Entwicklungsprozess entstandene Konstrukte. Aus praxisinformierter wissenschaftlicher Sicht und damit wiederum im Interesse wirkungsvoller Praxis sind die Bedingungen und Verläufe dieses Entwicklungsprozesses zu untersuchen. Sowohl im individuellen als auch im kollektiven Erleben von Schuldzuweisung und Schuldgefühl, von Strafen und bestraft Werden manifestieren sich Machtverhältnisse und die dazu gehörigen Affekte. Die Realität des Strafens ist immer sowohl ein wieder Erleben von internalisierten, gegebenenfalls sexualisierten Macht- und Abhängigkeitsbeziehungen als auch eine Widerspiegelung von sozio-ökonomischen Machtverhältnissen. Im Geiste einer aufgeklärten, humanen, an Nachsozialisation statt an schlichter Ausschließung orientierten Kriminalpolitik, aber auch im Interesse eines ökonomischen Umgangs mit menschlichen Ressourcen ist die Reflexion und Begrenzung der Machtbeziehungen im konkreten forensischen Wirkungsfeld unerlässlich." "Rather than as facts given by nature, guilt and punishment must be considered a constructs which developed in long-lasting social processes. In a perspective informed by practice and in the interest of efficiency it is worthwhile to research conditions and trajectories of this process. Both in individual and in collective experience of ascription and experiencing of guilt the social context of power relations and pertaining affects are reflected. The reality of punishment always represents the re-experiencing of internalised, possibly sexualised, relationships of power and dependence. It also mirrors socio-economic power conditions. In the spirit of an enlightened, humane crime policy, interested in socialisation rather than in mere exclusion, but also in the interest of an economic and efficient handling of human resources, the reflexion and limitation of power relationships in any concrete forensic field appears indispensable."
