"Verfahren schaffen die rechtlichen Rahmenbedingungen, gesellschaftliche Konflikte beizulegen. Sie finden nicht nur im engeren juristischen Bereich Anwendung, sondern breiten sich zunehmend auch auf anderen Feldern zur Konfliktlösung aus. Die Erörterungstermine, die im Rahmen der Verwaltungsverfahren zur Genehmigung von Freisetzungen gentechnisch manipulierter Pflanzen stattgefunden haben, stellen den Hintergrund für den empirischen Teil der vorliegenden Arbeit dar. Sie sind ein Beispiel für die Übertragung des 'Verfahrenskonzepts' auf das Feld der Technikfolgenabschätzung und der Umsetzung seiner Ergebnisse. Die Verfasserin führt an diesem Beispiel vor, wieweit die Annahmen und Ergebnisse der sozialpsychologischen 'Procedural-Justice'-Forschung tragen, welche die Einschätzung von 'Verfahrensgerechtigkeit' zur wichtigsten Quelle der Legitimation erklärt. Sie setzt sich mit verschiedenen theoretischen Konzepten zur Legitimation von Entscheidungen auseinander und illustriert außerdem empirisch die Vielfältigkeit impliziter Konzepte von Verfahrensgerechtigkeit bei den Beteiligten." "Proceedings set the basic legal parameters for resolving societal conflicts. Proceedings are used not only in the narrower field of jurisprudence; increasingly they find employ in other areas of conflict resolution. The empirical part of this study is based upon a series of expert hearings that were held concurrent to administrative procedures taking place in Germany for approving the release of genetically modified crop plants. These hearings represent an example of how the concept of proceedings from the field of jurisprudence has been transferred to the field of technology assessment and the implementation of its results. The author uses this example to show to what extent the assumptions and conclusions drawn from sociopsychological procedural justice research contribute to making the assessment of procedural justice the most important source of its legitimacy. This study analyzes a variety of different theoretical concepts for the legitimacy of decisions and it demonstrates empirically the manifoldness of implicit concepts of procedural justice held by participants involved in such hearings."
