Die Fallstudie geht der Frage nach, warum die Arbeitgeberverbände der Metall- und Elektroindustrie seit Beginn der 2000er Jahre keine neuen Mitglieder mehr generieren können sowie dem damit verbundenen Bedeutungsverlust der Flächentarifverträge in dieser Branche. Gefragt und analysiert wird, welche Bedeutung dabei der Wahrnehmung und Realität gewerkschaftlicher Gegenmacht zukommt, der tariflichen Verhandlungspraxis sowie den ökonomischen und sozialstrukturellen Veränderungen in der Branche. Die Studie bezieht sich auf die Metall- und Elektroindustrie der Region Köln und konzentriert sich auf die Entwicklung der Branchen Auto- und Autozulieferindustrie, Maschinenbau und Elektroindustrie, Industrielle Dienstleistungsbetriebe. Die Fallstudie hat zum Ergebnis, dass der Flächentarifvertrag zwar für deutlich weniger Betriebe, aber immer noch hohe Beschäftigtenzahlen unmittelbare Bindungskraft entfaltet. Als normsetzende Instanz prägt er informell auch die zunehmende Zahl von Haustarifverträgen. Gleichwohl verändern Haustarifverträge und tarifliche Öffnungsklauseln die traditionelle Rollenverteilung in den dualen industriellen Beziehungen zwischen Betriebsräten und Gewerkschaften, minimieren die Organisations- und Machtressourcen der Arbeitgeberverbände und deren Wirksamkeit in den tariflichen Verhandlungsprozessen. Mit dem sinkenden Stellenwert der Flächentarifverträge gehen auch den Arbeitgeberverbänden wichtige Funktionen verloren. Machtverluste der Arbeitgeberverbände sowie betriebliche Organisationsschwächen der Gewerkschaften fördern die sukzessive Auflösung traditioneller Organisationsbindungen von Arbeitgebern, forcieren ihre duale Reorganisation in Tarif- und OT-Verbänden und begründen die Ausweitung tariffreier Zonen.... view less

The case study investigates why the employers' associations in the metal and electrical industry have not been able to generate new members since the beginning of the 2000s and the associated loss of importance of the regional collective agreements in this industry. The question is asked and analysed as to the significance of the perception and reality of trade union countervailing power, collective bargaining practice and the economic and socio-structural changes in the industry. The study refers to the metal and electrical industry in the Cologne region and concentrates on the development of the automotive and automotive supplier industry, mechanical engineering and electrical industry, industrial service companies, and in each case on relevant major companies in the region. The case study has shown that although there are significantly fewer companies that are directly bound by a regional collective agreement, there are still large numbers of employees. As a standard-setting body, it also informally shapes the company collective agreements. Nevertheless, company agreements and opening clauses in collective agreements change the traditional division of roles in the dual industrial relations between works councils and trade unions, minimising the organisational and power resources of the employers' associations and their effectiveness in collective bargaining processes. With the declining significance of the regional collective agreements, the employers' associations also lose important functions or are expropriated from them in line with the market economy. Loss of power by the employers' associations and weaknesses in union organisation at the workplace promote the gradual dissolution of employers' traditional organisational ties, force their dual reorganisation in collective bargaining and in the OT associations.... view less
