Der Beitrag schließt an die Darstellung der Begutachtungs- und Urteilsdilemmata im Fall des norwegischen Attentäters Anders Behring Breivik durch Stroeve (in diesem Heft) an. Auf der Matrix erkenntnistheoretischer Arbeiten von Bachelard, Canguilhem und Althusser werden Charakteristika der Gutachtenerstattung in den als 'konjektural' einzuordnenden Wissenschaften der Psychiatrie und Psychologie herausgearbeitet, hinsichtlich komplementärer Diskursformen von Wissenschaft - Ideologie - Theorie - Praxis - Ethik diskutiert und auf soziale Repräsentationen von Wissenschaft und 'common sense' bezogen.
Am Beispiel Breiviks werden Probleme gutachterlicher Ideologie benannt, vor der Matrix eines dichotomen 'bad or mad' Versuchungen einer Pathologisierung politisch Radikalisierter aufgezeigt, die Notwendigkeit ethnopsychiatrischer bzw. -psychologischer Feldkompetenz hergeleitet, Implikationen objektivierender Dekonstruktion bzgl. einer ethisch gebotenen Re-Instituierung des Täters erörtert sowie die Aufspleißung gutachterlicher Wissenschaftlichkeit in eine reduktionistische Methodik und eine positivistische Wissenschaftsideologie belegt.... view less

This contribution refers to the description of the expert’s dilemmas concerning the case of the Norwegian assassin Anders Behring Breivik. By means of the epistemological research of Bachelard, Canguilhem and Althusser as reflecting matrix, the author works out the characteristics of forensic testifying in conjectural sciences like psychiatry and psychology. Complementary discursive forms of science - ideology - practice - ethics are discussed and applied to social representations of science and common sense. Breivik's case is used to exemplify problems of the expert’s ideology, of a temptation to pathologize political extremists in context of a bad-or-mad-dichotomy. The author discusses the need of ethnopsychiatric and ethnopsychological competences as well as implications of objectivating deconstruction with reference to an ethically necessary re-instituting of the offender. He gives evidence for a splitting of the expert’s scientific standards in a reductionistic method and a positivistic scientific ideology.... view less
