"Die Rahmenrichtlinie 89/391/EWG bezweckt die Durchführung von Maßnahmen zur Verbesserung der Sicherheit und des Gesundheitsschutzes der Arbeitnehmer. Dabei wird einer Ausweitung der Mitwirkungsrechte der Arbeitnehmer besondere Bedeutung beigemessen. Vor dem Hintergrund der erheblichen Unterschiede der rechtlichen Ausgestaltung des Systems der industriellen Beziehungen in den einzelnen Mitgliedstaaten stößt dieses Vorhaben auf Schwierigkeiten. Der Beitrag beschäftigt sich mit der Frage, inwieweit es dem Gemeinschaftsrechtssetzer gelungen ist, die Mitwirkungsrechte der Arbeitnehmer im Bereich des Arbeits- und Gesundheitsschutzes zu stärken. Es zeigt sich, daß die Rahmenrichtlinie erstmals über die Zuerkennung von bloßen Informations-, Anhörungs- und Vorschlagsrechten hinausgeht und eine wirkliche Sicherheitspartnerschaft auf der Grundlage einer ausgewogenen Beteiligung der Arbeitnehmer fordert. Dies beinhaltet u.a. die Pflicht zur Durchführung von Verhandlungen über alle relevanten Fragen mit dem ernsten Willen zur Einigung. Die Durchführung der gemeinschaftsrechtlichen Vorgaben zur Mitwirkung der Arbeitnehmer im Bereich des betrieblichen Arbeitsschutzes in den Mitgliedstaaten ist bislang nicht zufriedenstellend. Während diesbezüglich ein Umsetzungsakt in Deutschland gänzlich fehlt, weisen die entsprechenden Regelungen in Großbritannien, aber auch in Italien Defizite auf." (Autorenreferat)... view less

"The directive 89/391/EEC seeks at the introduction of measures to encourage improvements in the safety and health of workers at work. In doing so special importance is attached to an extension of the participation rights of workers. Against the background of considerable differences of the legal structure of the industrial relations system of the member states this purpose encounters a number of difficulties. This article deals with the question, of how far the community legislator has succeeded in strengthening the participation rights of the workers in the field of safety and health. It shows the directive, for the first time, goes beyond the adjudication of mere rights of information, and consultation, and makes proposals requiring all questions related to matters of health and safety at work to be handled in a true partnership for safety on the basis of employee participation. This includes among other things the obligation to negotiate about all relevant questions in good faith will to come to an agreement. The implementation of the community provisions regarding the participation of the workers in the field of safety and health in the member states up to now is not satisfactory. While legislation implementing the directive is entirely lacking in Germany, the corresponding laws in the UK and Italy also have notable shortcomings." (author's abstract)... view less
