Vor nunmehr 10 Jahren trat die sog. BauROG-Novelle in Kraft, worin das Raumordnungsgesetz
(ROG) neben dem Baugesetzbuch (BauGB) eine grundlegende Novellierung
erfahren hat. Es wurden zahlreiche neue Instrumente eingeführt, deren Wirkungen
sich vollzugsbedingt erst nach einigen Jahren sinnvoll evaluieren lassen. Nicht zuletzt
vor dem Hintergrund der neuerlichen Novellierung des ROG, diesmal im Zeichen der
Föderalismusreform, stellt sich die Frage der Beibehaltung oder Abschaffung von tradierten
Instrumenten. Daher soll im Folgenden der Regelung in § 7 Abs. 2 Satz 2 ROG,
die gemeinhin als raumordnerische Ausgleichsregelung bezeichnet wird, nachgegangen
werden. Die Norm enthält folgenden Wortlaut: „Bei Festlegungen nach Satz 1 Nr. 2
kann zugleich bestimmt werden, dass in diesem Gebiet unvermeidbare Beeinträchtigungen
der Leistungsfähigkeit des Naturhaushalts oder des Landschaftsbildes an anderer
Stelle ausgeglichen, ersetzt oder gemindert werden können.“
Nach einer Einleitung und der Skizzierung des Hintergrundes (Kap. 1 und 2) folgt die
rechtliche Würdigung der Norm (Kap. 3). Hierbei ist ausführlich auf die Anwendungsmöglichkeiten
einzugehen, die sowohl die Ausgleichsregelung nach Naturschutzrecht
(§ 18 BNatSchG), nach Städtebaurecht (§ 1 a Abs. 3 BauGB) als auch nach Wasserrecht
(§§ 31, 31 a WHG) betrifft. Im Anschluss daran erfolgt eine rechtstatsächliche Auswertung
im Hinblick auf die Anwendung der Norm bezüglich der Übernahme in Landesrecht
sowie in der Planungspraxis, d. h. der Berücksichtigung von Ausgleichsmaßnahmen
in Raumordnungsplänen (Kap. 4). Schließlich werden Schlussfolgerungen mit

It is now ten years since significant amendments to German planning law came into
force with fundamental revision of both the Federal Regional Planning Act (ROG) and
the Federal Building Code (BauGB). This process introduced an array of new instruments
whose effects, given the time required for implementation and execution, can only
reasonably be evaluated after a period of years. It is not least against the background of
a further and more recent amendment to the ROG, in this case under the watchword of
reforming Germany’s federal structure, that questions have been voiced as to whether
the more traditional instruments should now be retained or abolished. In this light, this
paper explores the statutory requirement contained in Section 7 para. 2 sentence 2 of
the ROG, generally referred to as the mitigation provision. The wording is as follows:
“Stipulations in accordance with sentence 1, paragraph 2, may also establish the need to
compensate for, make good or limit unavoidable damage to the ecological balance or
the countryside in this area elsewhere.”
After an introduction and outline of its background (Chapters 1 and 2), there follows
a legal assessment of the regulation (Chapter 3). Here it is important to give detailed
consideration to the scope for application, which also involves rules on mitigation under
nature-protection legislation (Section 18 Federal Nature Protection Act), under
urban-development law (Section 1 a sub-section 3 Federal Building Code) and under
water legislation (Sections 31 and 31 a of the Federal Water Act). This is followed by
an appraisal of the actual legal implications of the requirement with regard to application
of this norm and its adoption both within state-level legislation and in planning
practice, i. e. consideration shown for mitigation measures in actual spatial-development plans (Chapter 4). The final chapter (Chapter 5) contains a number of
